Jon Gosselin plans to sue Kate Gosslein for custody of their sextuplets

Apparently, when Kate took Mady and Cara to New York for the appearances, she didn't give Jon the opportunity to watch the younger kids -- a violation of their custody agreement. Now, according to In Touch, Jon wants to sue for primary custody.

"First, I'm going to file for an emergency petition for contempt ... The next step is to fight for custody," Jon tells the magazine. "It's the only way I can protect the younger six."

Jon tells In Touch he plans to file the papers as soon as he can save up enough money for the legal fees. "Regardless of what the judge decides, I have to at least try," says Jon. "I just wish Kate would wake up, realize how she's behaving -- and change her ways."

Jon also reveals that the younger kids are scared of their mother. "They live in fear of Kate. Every time I see them, they tell me they want to live with me," he says.
